These Terms of Use (“Terms”) govern your access to and use of oursqlfoundation.org (the “Site”), operated by The OurSQL Foundation, a 501(c)(6) non-profit organization headquartered at 4819 Emperor Boulevard, Suite 400, Durham, NC 27703, United States (“OurSQL Foundation,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful purposes consistent with its intended function: learning about the OurSQL Foundation, our mission, our community, and our work around MySQL and MySQL-compatible technologies, and engaging with us (for example, through our Contact Us form or newsletter). You agree not to:

Attempt to gain unauthorized access to the Site, its systems, or related networks.
Interfere with or disrupt the Site’s operation, security, or availability.

All content on the Site — including text, graphics, logos, the OurSQL Foundation name and marks, and design elements — is the property of The OurSQL Foundation or its licensors and is protected by applicable intellectual property laws, except where otherwise noted. You may view, download, and print Site content for your personal, non-commercial reference. Any other use, reproduction, or distribution requires our prior written permission.

To the fullest extent permitted by applicable law, the OurSQL Foundation and its board members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, arising out of or related to your access to or use of, or inability to access or use, the Site.

7. Indemnification

You agree to indemnify and hold harmless the OurSQL Foundation and its board members, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site or violation of these Terms.

8. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated “Effective Date” at the top of this page. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
